Senate Substitute for HOuse Bill No. 2099*
An Act concerning the disposition of state real property; authorizing the secretary of corrections on behalf of the department of corrections and the state of Kansas to convey certain real property in Leavenworth county, Kansas, to Leavenworth county.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) The secretary of corrections is hereby authorized and empowered, for and on behalf of the department of corrections and the state of Kansas, to convey, without consideration, all of the rights, title and interest in the following described real estate, and any improvements thereon, to Leavenworth county, Kansas:
All of Blocks 20, 21, 22, 23, 33, 34, 35, 36, 46, 47, 48 in the Town of
Delaware, a subdivision recorded in Plat Book 1A, Page 50 and all that part of Blocks 7, 8, 9, 10 in said subdivision, lying West of Union Pacific Railroad and all that part of Blocks 49, 59, 60, 61 in said subdivision lying East of K-5 Highway (Wolcott Road). Including all vacated alleys and streets in said Blocks. All being located in Section 20, Township 9 South, Range 23 East of the Sixth Principal Meridian, Leavenworth County, Kansas.
(b) Conveyance of such rights, title and interest in such real estate, and any improvements thereon, shall be executed in the name of the department of corrections and the state of Kansas by the secretary of corrections. The deed for such conveyance shall be by quitclaim deed.
(c) No conveyance of real estate and improvements thereon as authorized by this section shall be made by the secretary of corrections until the deed and conveyances have been reviewed and approved by the attorney general.
(d) All costs in any way related to the conveyance shall be paid by Leavenworth county, Kansas. The conveyance of real property authorized by this section shall not be subject to the provisions of K.S.A. 75-3043a, and amendments thereto.
(e) In the event that the secretary of corrections determines that the legal description of the real estate described by this section is incorrect, the secretary of corrections may convey the property utilizing the correct legal description but the deed conveying the property shall be subject to the approval of the attorney general.
Sec. 2. This act shall take effect and be in force from and after its publication in the statute book.
