Notice of Proposed Kansas Air Quality Construction Permit
Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality construction permit. Merit Energy Company, LLC – Napeste 28 CTB has applied for an air quality construction permit in accordance with the provisions of K.A.R. 28-19-300. Emissions of (volatile organic compounds (VOC), methane (CH4), and hazardous air pollutants (HAPs)) were evaluated during the permit review process.
Merit Energy Company, LLC – Napeste 28 CTB, 13727 Noel Rd., Suite 1200, Dallas, TX 75240, owns and operates crude oil and natural gas production facility located at S28 T24S R32W, Garden City, KS 67846, at which a new tank battery for storage of crude oil and natural gas is to be installed or constructed two (2) gunbarrel tanks, eight (8) oil tanks, and four (4) water tanks, fugitive equipment and truck loading.
A copy of the proposed permit, permit application, all supporting documentation, and all information relied upon during the permit application review process are available for public review from the date of publication during normal business hours at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366 and at the KDHE Southwest District Office, 313 Oklahoma Terr., Ulysses, KS 67880. To obtain or review the proposed permit and supporting documentation, contact Ankit Poudyal Chhetri at the central office of KDHE at 785-296-0365, or Ethel Evans at the Southwest District Office at 620-356-1075. The standard departmental cost will be assessed for any copies requested. The proposed permit, accompanied with supporting information, is available, free of charge, at the KDHE BOA Public Notice website at https://www.kdhe.ks.gov/413/Public-Notices.
Please direct written comments or questions regarding the proposed permit to Ankit Poudyal Chhetri, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366. In order to be considered in formulating a final permit decision, written comments must be received no later than 12:00 p.m.
A person may request a public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Ankit Poudyal Chhetri, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than 12:00 p.m., in order for the Secretary of Health and Environment to consider the request.
