Notice of Hearing

The Kansas Department of Health and Environment (KDHE) has prepared a revised draft Total Maximum Daily Load (TMDL) for Cow Creek in the Lower Arkansas River Basin. This revised draft addresses EPA comments by including the assignment of wasteload allocation for two facilities. This river is impaired for total phosphorus and does not meet state surface water quality standards.

The total phosphorus TMDL presented for public review is:

KDHE TMDL website at http://www.kdhe.ks.gov/1443/. A public hearing to take testimony from interested parties will be held virtually:

The first portion of the hearing will be a briefing outlining the TMDL, and the second portion of the hearing will be open for public comment. The public comment period for these TMDLs will be held open from July 24, 2025 through August 25, 2025. After reviewing the testimony and public comments, KDHE will make appropriate revisions to the TMDLs and submit them to Region 7 of the U.S. Environmental Protection Agency.
