Notice of Water Quality Certification

The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by the Kansas Department of Transportation for United States Army Corps of Engineers (USACE) Public Notice No. NWK-2018-01264 authorization found at https://www.nwk.usace.army.mil/Media/Public-Notices. The applicant proposes the placement of fill materials within wetlands and stream channels for the purpose of adding capacity and widening a section of the South Lawrence Trafficway (SLT). The work would increase traffic capacity through this section of roadway over the current condition. Water bodies impacted totaling nine stream channels and six wetlands within the project area include Yankee Tank Creek and the Wakarusa River.

The draft certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before March 14, 2024. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to KDHE at KDHE.NPS@ks.gov by April 14, 2024, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
